Terms of hire








This is the rental contract between Hibiscus Coast Party Hire and the person hiring our equipment.

Hire Period

The hire period commences at the time shown on your invoice, which is the day the equipment leaves  Hibiscus Coast Party Hire premises. The hire period shall terminate at the date stated on the invoice. By that time the equipment is to be delivered back to the Hibiscus Coast Party Hire premises either by the hirer or by Hibiscus Coast Party Hire when requested.

Hire Charges

Equipment is hired on a daily, 3 day or weekly basis. In the absence of special arrangements to the contrary, equipment is hired on a daily rate. The minimum charge for any hire will be the rate for one day irrespective of the length of hire as outlined in the Hibiscus Coast Party Hire price list. The hire period, and the corresponding rate applies from the time the equipment leaves the Company’s premises to the time that it is returned.

Deposit and Payment

A deposit is required to secure a booking, the balance being paid before collection or delivery. Full payment is required prior to collection or delivery of the hire equipment. Payment will include an appropriate bond, a refund will be made to the Hirer on returning the equipment in good order and condition. If the equipment is returned unclean, or with damage, missing items, or stains, the bond will be retained by the company. This will be done within 28 days of the hire. The Hirer by accepting the goods or services agrees to the terms and conditions as laid down by Hibiscus Coast Party Hire and agrees to pay any costs of collection and all legal fees incurred by Hibiscus Coast Party Hire in the event of legal action becoming necessary.

Delivery and Removal of Equipment

The hirer authorises Hibiscus Coast Party Hire staff to bring its vehicles onto their property to deliver and collect the equipment. Hibiscus Coast Party Hire shall not be responsible to the hirer or any third parties for any damage that may be done to driveways, grass areas, underground services, or anything else. The hirer will be present at the delivery address to acknowledge receipt of the equipment hired. If the hirer is not present, Hibiscus Coast Party Hire may charge the hirer $20.00 per person per hour while the persons doing the delivery are waiting.  Delivery is based on a door to door service, if access issues or stairs present hirer must make available a person to assist with carting.

The hirer is responsible for checking the equipment on collection or delivery. Hibiscus Coast Party Hire cannot accept responsibility for shortages or claims after the hirer takes possession. Where the hirer is not available to check equipment being delivered or collected, the hirer shall not be entitled to subsequently dispute the amount of or condition of the equipment recorded in writing as returned by the company at the time of return.

Collection: Equipment must be packed ready for loading at the entrance to building and assistance given to the Owner's driver if more than one person is required to load it.

Care of Equipment and Breakdowns

The Hirer shall take proper care of the equipment and shall indemnify Hibiscus Coast Party Hire against any damage or loss or from theft. The Hirer must reimburse Hibiscus Coast Party Hire in full for any damage or loss immediately upon termination of hire. The Hirer warrants that he is competent and qualified to use the equipment in the way or which it is designed. Breakdown resulting from misuse shall not in any circumstances shorten the period of hire. It is the Hirers responsibility to satisfy themselves that the equipment is suitable for the work intended and that it is used in a way that complies with all statutory requirements. The equipment does not purport to be new stock or equal to new, but when sent out all items are understood to be in good condition and fit for normal use. Hibiscus Coast Party Hire is not liable for any loss suffered by the Hirer or liability incurred by the Hirer as a result of the breakdown of the equipment howsoever caused. In the event of breakdown, the Hirer must immediately notify the owner by telephone.

Cancellation of Hire

Bookings canceled 90 days prior to booking date 50% of the deposit will be withheld. If canceled within 90 days of booking date 100% of the deposit will be withheld. Cancellation within 24 hours of booking will incur full hire costs. In any circumstances where cancellation occurs, and the Company has incurred additional costs such as loading of vehicles, transportation of equipment, or utilization of labour, then additional fees may also be incurred by the hirer.

Right to Terminate Hire

Hibiscus Coast Party Hire may terminate the hire at any time without providing any reason for so doing, either verbally or in writing. Hibiscus Coast Party Hire will not be responsible to the hirer for any loss they may claim to have suffered in respect of such termination. This could pertain to adverse weather or work conditions in the case of marquee hire. Notwithstanding termination of the hire the hirer shall be obliged to pay Hibiscus Coast Party Hire a sum equivalent to hire fees at the rate specified therein in respect of any period from the date of termination of the hire until the equipment is actually returned to Hibiscus Coast Party Hire premises.

No Warranties by Owner

Hibiscus Coast Party Hire makes no warranty or representations to the state, quality, or fitness of any equipment for any particular purpose and no such warranty shall be implied from the description of the equipment on the quote form/hire list. All implied warranties and conditions as to the state, quality or fitness of the equipment for any purpose are hereby excluded.

The hirer shall, forthwith on request by Hibiscus Coast Party Hire advise the whereabouts of the equipment and allow the company, its agents, or employees reasonable time to inspect and test the equipment and for such purposes the hirer hereby gives irrevocable leave and license to the company and its employees and agents to take possession of and remove the same to enter upon any premises where the equipment of any of the same or any part thereof may be.

The “person in charge” of a function or event is also responsible for ensuring the safe and legal use of all dangerous or hazardous goods. This includes the use of gases including LPG for heating and cooking appliances.

No Assignment of Equipment or Agreement - The hirer shall not sublet the equipment to any other person, but this shall not prevent employees of the hirer using the equipment in conformity with this agreement.

Disputes: No claim relating to goods and services will be considered unless made within seven (7) days of completion of goods and services.

Acceptance of Terms & Conditions - The hirers' payment of the deposit will acknowledge acceptance of the terms and conditions of hire.
